I have a horse that I bought for my giftee that I would like to GM out. She is a foundation horse, not bred and is something that I own.

I will not post the horse here, but will gladly send the link privately for those that want to see why I cant GM her

Does she have any foals and is she color tested?

1 foal back in sept and yes color tested

this is what it says...."You may modify the genetics of any horse you own that is unbred, and gene tested." does that mean unbred as never? or unbred this season?

If they have living relatives, then you can not gene mod them. The foal will have to be sold back to the game (and any foal that foal has had if it has been bred too) for the horse in question to be gene moddable
