    If I give/sell someone this horse, does the buyer get the genes with it?

    Only players with the licenses for those genes can purchase this horse. So, for example, I don't have licenses for Chinchilla or Diamond Sparkle, so I can not purchase this horse. If I did already have those licenses, I could buy her.
    However, I believe you can gift her to a non-licensed player during the gift exchange, which would also give the player the licenses. But I might be off on that.

    Fiddler: You don't need licenses for gelded or spayed horses, so if you bought that pony already altered, you wouldn't have needed the license.

    Edit: also as a side note you do have those licenses for chinchilla and diamond sparkle, Oops. If you have more horses with those genes then nothing will happen to your license. I don't believe you can give away licenses except during the exchange.
